Plain-English Summary MyVisualDashboard is a data visualisation platform that helps you turn your financial, project, and workforce data into dashboards. By using this platform you agree to these Terms. Key points: your data belongs to you and is not sold to anyone; our liability for any loss is strictly limited; we depend on third-party services that may change or go offline; these Terms are governed by Queensland, Australian law.
Section 01

Definitions

In these Terms and Conditions, the following definitions apply:

  • "Platform" means the MyVisualDashboard web application accessible at myvisualdashboard.com and any associated subdomains, APIs, or mobile interfaces.
  • "We", "Us", "Our" means MyVisualDashboard, operated as a business under Australian law, with a principal place of business in Queensland, Australia.
  • "User", "You", "Your" means any individual or entity that registers for, accesses, or uses the Platform.
  • "Account" means a registered user profile associated with a unique email address on the Platform.
  • "Content" means any data, files, text, spreadsheets, schedules, or other materials uploaded to or generated on the Platform.
  • "Subscription" means a paid plan granting access to Platform features as described in the Pricing section of the website.
  • "Third-Party Services" means external software, APIs, libraries, fonts, hosting services, and infrastructure upon which the Platform depends.
  • "ACL" means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Section 02

Acceptance of Terms

By accessing or using the Platform in any way — including browsing the website, registering an Account, uploading data, or using any feature — you agree to be legally bound by these Terms and Conditions, our Privacy Policy, and any additional terms applicable to specific features.

If you do not agree to these Terms, you must not use the Platform. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and "You" shall refer to that organisation.

These Terms constitute a legally binding agreement under the laws of Queensland, Australia. Your continued use of the Platform after any modification to these Terms constitutes your acceptance of the modified Terms.

Section 03

Description of Service

MyVisualDashboard is a web-based data visualisation and analytics platform that enables users to upload structured data files (including .xlsx, .csv, and .xer formats) and generate interactive dashboards, charts, reports, and workforce planning tools.

Current Platform modules include:

  • Income / Expense Analysis — financial dashboards including cumulative trends, month-on-month comparisons, ABC Pareto analysis, account summaries, and top-category breakdowns
  • Project Management Analytics — Gantt chart builder, key milestone movement reporting, schedule analysis suite, baseline vs actual comparisons, and float distribution reporting
  • Asset Management — personal and business asset registers with service tracking, warranty monitoring, insurance management, calibration scheduling, and automated email notifications
  • HR & Workforce Planning — resource pool management, task list creation, role-based task-resource mapping, and daily resource allocation heatmaps

We reserve the right to add, modify, suspend, or remove any feature, module, or functionality of the Platform at any time, with or without notice, at our sole discretion.

Section 04

Accounts & Registration

To access most Platform features, you must create an Account by providing a valid email address and password. You agree to:

  • Provide accurate, current, and complete information during registration and keep it up to date
  • Maintain the security and confidentiality of your Account credentials
  • Notify us immediately at admin@myvisualdashboard.com of any unauthorised access or security breach
  • Accept responsibility for all activity that occurs under your Account
  • Not share your Account credentials with any third party
  • Not create multiple Accounts for the purpose of circumventing plan limitations

We reserve the right to suspend or terminate any Account that we reasonably believe has been compromised, is being misused, or is in breach of these Terms.

Accounts are currently single-user. Each Account is tied to one individual. Enterprise or multi-user arrangements may be negotiated separately by contacting us directly.

Section 05

Subscription, Billing & Plans

The Platform offers the following subscription plans (pricing in Australian Dollars, inclusive of GST where applicable):

AUD $8.00/month per user (monthly billing) · AUD $76.80/year per user (annual billing, saving ~20%)
Pro Plan
AUD $15.00/month per user (monthly billing) · AUD $144.00/year per user (annual billing, saving ~20%)
  • Payment is accepted via Bank Transfer, Visa, or Mastercard
  • Monthly subscriptions renew automatically each calendar month unless cancelled
  • Annual subscriptions renew automatically each year unless cancelled at least 14 days before renewal
  • You may cancel your subscription at any time; access continues until the end of the paid billing period
  • Annual plan cancellations within 30 days of purchase are eligible for a pro-rated refund less any period already used
  • No refunds are issued for monthly subscriptions once the billing period has commenced
  • We reserve the right to change pricing with at least 30 days written notice to your registered email address
  • All pricing is subject to Australian Goods and Services Tax (GST) where applicable under A New Tax System (Goods and Services Tax) Act 1999 (Cth)
Section 06

Your Data & Privacy

Your data belongs to you. We do not claim ownership of any content you upload to or generate on the Platform.

Data storage approach by module:

  • Income / Expense & Project Management dashboards — uploaded files are parsed on our servers to generate dashboards. The raw file and parsed data are not stored permanently; they exist only for the duration of your active session. Once you navigate away, the source data is cleared from server memory. We hold no persistent copy of your financial or project data.
  • Asset Management (PAM & BAM) — asset records are stored in an encrypted database on our servers, private to your Account and not accessible to other users.
  • HR & Workforce Planning — all workforce data (Resource Pool, Task List, Task-Resource Mapping, Resource Allocation) is stored exclusively in your browser's localStorage. No workforce data is transmitted to or stored on our servers.

We collect and process personal data (name, email address, billing information) as described in our Privacy Policy, in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We do not sell, rent, or share your personal data with third parties for marketing purposes.

You are solely responsible for ensuring that any data you upload does not violate applicable laws, third-party rights, or confidentiality obligations.

Section 07

Data Loss & Limitation of Liability

Please read this section carefully. It significantly limits our legal liability to you.

DATA LOSS DISCLAIMER: MyVisualDashboard processes data files on a session-by-session basis. For modules that do not persist data on our servers (Income/Expense Analysis and Project Management dashboards), no backup of your uploaded data is maintained by us. If you lose, overwrite, or delete your source files, we are unable to recover them. You are solely responsible for maintaining your own copies of all data you upload to the Platform.

For modules that store data on our servers (Asset Management), while we take reasonable steps to back up data, we do not guarantee that backups will be available, complete, or restorable at any given time. Hardware failures, hosting provider outages, or software errors may result in permanent data loss.

For HR & Workforce modules that store data in your browser's localStorage, clearing your browser data, switching browsers, or using private/incognito mode will result in permanent loss of all locally stored data. We have no ability to recover browser-stored data under any circumstances.

We strongly recommend that all users export their data to Excel (XLSX) regularly using the built-in export functions and maintain independent backups.

To the maximum extent permitted by applicable law, including the ACL:

  • Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Platform — whether in contract, tort (including negligence), statute, or otherwise — is limited to the greater of: (a) the total fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim; or (b) AUD $100.00
  • We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of data, loss of goodwill, loss of business opportunity, or business interruption — even if we have been advised of the possibility of such damages
  • We are not liable for any loss or damage arising from your failure to maintain adequate backups of your data
  • We are not liable for downtime, service interruptions, or data loss caused by our third-party hosting provider (Hostinger) or any other third-party service
  • We are not liable for the accuracy, completeness, or suitability of dashboards or reports generated from data you provide
  • We are not liable for any decisions made by you or your organisation based on information displayed on the Platform

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the ACL that cannot lawfully be excluded or limited. Where the ACL implies a guarantee that cannot be excluded, our liability for breach of that guarantee is limited, to the extent permitted by law, to re-supplying the services or paying the cost of re-supplying the services.

Section 08

Third-Party Services & Dependencies

The Platform relies on the following third-party services, libraries, and infrastructure. We make no warranties regarding the continued availability, accuracy, or fitness for purpose of any third-party service. Changes to or discontinuation of any of these services may affect Platform functionality without prior notice.

THIRD-PARTY DEPENDENCY DISCLAIMER: We do not control, endorse, or assume responsibility for any third-party service listed above. Any failure, change, deprecation, or discontinuation of a third-party service may affect Platform features without notice. We are not liable for any loss, damage, or service interruption caused by third-party service failures, changes to third-party terms, or third-party security incidents.

In particular: Hostinger's infrastructure outages directly affect all Platform availability. Google Fonts requests expose your IP address to Google. SheetJS licence terms may change. Browser localStorage data can be lost by clearing browser data, using private browsing, or browser updates — we have no access to or control over browser-stored data.

Section 09

Intellectual Property

All intellectual property in the Platform — including but not limited to the software code, interface design, dashboard templates, algorithms, branding, logos, and documentation — is owned by or licensed to MyVisualDashboard and is protected by Australian and international intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal or internal business purposes in accordance with your Subscription plan.

You must not:

  • Copy, modify, distribute, sell, sublicense, or create derivative works of the Platform or its components
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the Platform's name, logo, or branding without our prior written consent
  • Represent that you created or own any part of the Platform

You retain full ownership of all data and content you upload to the Platform. By uploading content, you grant us a limited, non-exclusive licence to process and store that content solely to provide the services described in these Terms.

Section 10

Acceptable Use

You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations. You must not use the Platform to:

  • Upload, transmit, or process data that you do not have the right to use, that is illegal, defamatory, or that infringes any third-party rights
  • Attempt to gain unauthorised access to the Platform, its servers, or other users' accounts
  • Upload files containing malicious code, viruses, or any software designed to interfere with the Platform
  • Use automated scripts, bots, scrapers, or crawlers to access the Platform without our written consent
  • Circumvent, disable, or interfere with security features of the Platform
  • Use the Platform in any manner that could damage, disable, overburden, or impair its infrastructure
  • Conduct any activity that constitutes a criminal offence or gives rise to civil liability under Australian law
  • Upload personal information about other individuals without their consent, in violation of the Privacy Act 1988 (Cth)
  • Resell, white-label, or commercialise access to the Platform without our express written agreement

We reserve the right to investigate and take appropriate action against any user we believe is in breach of this section, including immediate account suspension, referral to law enforcement authorities, and civil action.

Section 11

Service Availability & Downtime

We aim to make the Platform available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted or error-free access to the Platform.

  • The Platform is hosted on Hostinger shared hosting infrastructure. Server-level outages, maintenance windows, or capacity issues are outside our direct control.
  • Scheduled maintenance may be performed from time to time. Where practicable, we will provide advance notice via your registered email address.
  • Hostinger's shared hosting environment enforces a server-side timeout of approximately 120–180 seconds per request. Processing of very large files may be affected by this limit.
  • We are not liable for any loss or damage resulting from Platform downtime, including loss of business, loss of data, or missed deadlines.
  • Email notifications (for asset due-date alerts) depend on both our server-side cron jobs and Hostinger's mail infrastructure. Delivery of notification emails is not guaranteed and may be delayed or blocked by recipient spam filters.

We do not offer any Service Level Agreement (SLA) or uptime guarantee under any current subscription plan. Enterprise SLAs may be negotiated separately.

Section 12

Termination

Either party may terminate your access to the Platform at any time.

  • By you: You may cancel your Subscription at any time through your account settings or by contacting us. Access continues until the end of the paid billing period. No refunds are issued for the remainder of the billing period, except where required by the ACL.
  • By us: We may suspend or terminate your Account immediately, without notice or liability, if we determine that you have breached these Terms, engaged in fraudulent activity, or if we are required to do so by law. We may also terminate any Account associated with non-payment of subscription fees after reasonable notice.

Upon termination:

  • Your right to access the Platform ceases immediately
  • Server-stored data (Asset Management records) associated with your Account may be permanently deleted after a 30-day grace period following termination
  • Browser-stored data (HR & Workforce module) remains in your browser and is not affected by account termination
  • You should export any data you wish to retain before requesting account deletion

Sections 7 (Limitation of Liability), 9 (Intellectual Property), 13 (Australian Consumer Law), and 14 (Dispute Resolution) survive termination of these Terms.

Section 13

Australian Consumer Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy available to you under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Under the ACL, you may be entitled to guarantees that cannot be excluded by contract, including guarantees that our services will be:

  • Provided with due care and skill
  • Fit for the purpose for which they are commonly supplied
  • Provided within a reasonable time (where no time has been agreed)

Where we fail to comply with a consumer guarantee under the ACL, and the failure is not a major failure, you are entitled to have the failure remedied within a reasonable time. If we cannot remedy the failure, you may be entitled to a price reduction or refund. Where a failure to comply with a consumer guarantee is a major failure, you may be entitled to a refund or to reject the service.

Nothing in these Terms limits your rights under the ACL in relation to goods or services supplied to consumers.

If you are a business user (not a consumer under the ACL), different limitations may apply. Contact us if you require clarification of your specific circumstances.

Section 14

Dispute Resolution

We prefer to resolve disputes quickly and informally. Before initiating any formal legal proceedings, you agree to:

  1. Contact us first by emailing admin@myvisualdashboard.com with a description of your complaint and the resolution you are seeking. We will respond within 10 business days.
  2. If the matter is not resolved within 30 days of your initial notice, either party may refer the dispute to mediation administered by the Queensland Law Society or a mutually agreed mediator, with costs shared equally.
  3. If mediation fails or is not appropriate, either party may pursue legal proceedings in the courts of Queensland, Australia.

These Terms are governed exclusively by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for any disputes arising out of or relating to these Terms or the Platform — except where mandatory consumer protection laws in your jurisdiction require otherwise.

Nothing in this section prevents either party from seeking urgent injunctive or interlocutory relief in any court of competent jurisdiction.

Section 15

Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Sending an email notification to your registered email address at least 14 days before the changes take effect
  • Displaying a prominent notice on the Platform when you next log in
  • Updating the "Last updated" date at the top of this page

Your continued use of the Platform after the effective date of any modified Terms constitutes your acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Platform and cancel your Subscription before the effective date of the changes.

For minor changes (such as typographical corrections, clarifications, or changes required by law), we may not provide advance notice, but will update the "Last updated" date.
